Bare Biology Ltd offers this website www.barebiology.com (“the Website”), including all information, tools and services available from this Website to you, the user, subject to your acceptance of all terms, conditions, policies and notices stated here.

By visiting our Website and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink which are incorporated into these Terms of Service by reference. These Terms of Service apply to all users of the Website, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

Please read these Terms of Service carefully before accessing or using our Website or purchasing any of the products we advertise through the Website (“our products”). By accessing or using any part of the Website, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of these Terms of Service, then you should not access the Website, use any services or purchase our products. Nothing on our Website or in these Terms forms an offer on our part to sell you any products.

 

Section 1 - Online store terms & children

We do not sell our products for purchase by children. Some of our products can be used by children but are for purchase by adults. If you are under the age of 18, then you may only use our Website or buy our products with the involvement of a parent or guardian who agrees that you can do so.

You may not use our products for any illegal or unauthorised purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.  Where we, in our reasonable opinion, believe there is or has been a serious breach or violation of any of the Terms, then it may result in an immediate termination of your Services or cancellation of any orders for our products.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the Website through which the service is provided, without our express written permission.

 

Section 2 – Ordering products

In this Section we set out how a legally binding contract between you and us is made for the purchase of our products. You place an order on our Website by completing the checkout instructions. Please read and check your order carefully before submitting it when prompted to do so. You will be able to correct any errors before submitting your order to us.

When you place your order at the end of the online checkout process e.g when you click on the ‘Pay Now’ or ‘Subscribe Now’ button, then we will check our stock levels. If we have stock available to fulfil your order and payment has been successfully taken, we will accept your order and display onscreen an order confirmation, with your order details. At this point a legally binding contract will be in place between you and us, for us to deliver the order as agreed during the online checkout process. After your order has been accepted, we will also send you an email confirming your order.

Some of our products may be available for purchase on a subscription basis. When you have requested that we set up a subscription and placed the order at the end of the online check-out process as described above in this Section, if we display onscreen an order confirmation with your order and subscription details, then at this point a legally binding contract will be in place between you and us, for us to deliver the order agreed during the online checkout process, at the intervals requested by you. See Section 6 for more information about subscriptions with us, including how to manage a subscription after one has been set up and cancellations. Our products are available for consumer use only, they are not intended for purchase by resellers, merchants or distributors. We take reasonable care to check content is accurate and complete before we publish it on the Website. However, because of issues involved with providing information through the internet, we are not responsible if information made available on this Website is not accurate, complete, current, available or fit for any particular purpose. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk. With specific reference to our food supplements, in the event of any safety concerns or for any other information about a product, please carefully ready the information provided with the product.

Content on this Website is not intended to substitute for advice given by a medical professional. You should contact your healthcare provider if you suspect you have a medical problem.

This Website may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. Section 4 - Modifications to the service and prices

All prices are in pounds sterling (£) and are inclusive of VAT at the applicable rate. Prices for our products are subject to change. If you are a repeat customer, then carefully check the price shown during checkout for one-time purchases for changes since your last purchase. Price changes for products ordered on a subscription basis are explained in Section 6.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. This will not affect any contracts between you and us we are legally obliged to fulfil.

 

Section 5 – Products, orders & cancellation

Certain products may be available exclusively online through the Website. These products may have limited quantities.

We have made every effort to display as accurately as possible the colours and images of our products on our Website. We cannot guarantee that your computer monitors display of any colour will be accurate. The packaging of our products may be different from that shown on our Website.

Unfortunately, as a small business, our operations do not support shipping our products worldwide. As a result we may limit the sale of our products into any geographic region or jurisdiction and this limit may be subject to change from time to time. You should note that we sell our products in quantities which are typical of the needs of the average household. This applies to the number of products ordered within the same order and the placing of several orders for the same product. We may limit the quantities of any products that we offer.

We reserve the right to discontinue any product at any time, this will not affect any contracts between you and us we are legally obliged to fulfil. Unless you and we agree otherwise, if we cannot deliver your order within 30 days from the date when:

i. the order is confirmed online as described in Section 2 for one-off purchases;
or
ii. a delivery occurrence of a product to be delivered to you is due, for products ordered on a subscription basis, then we will let you know, cancel your order and give you a refund.

In line with your statutory rights, the products we provide to you must be as described, fit for purpose and of satisfactory quality. We are under a legal duty to supply you with goods that are in conformity with these Terms of Service. You become responsible for our products when they have been delivered to the address provided when you placed your order. However, ownership of our products does not pass to you until they have been paid for in full, even if they have been delivered to you.

Information about how we handle product returns is in our [Returns and Cancellations Policy], including returns where our products arrived damaged or are otherwise not of satisfactory quality. You have a legal right to cancel an order for one-off purchases of our products for no reason within 14 days from receiving them. See our [Returns and Cancellations Policy] for more information, including our returns address which is not the same as our registered office address. Please note you will need to pay the cost of delivery when returning products where you have changed your mind. We may deduct from your refund any loss in value of our products resulting from the unnecessary handling by you. Information about how we handle subscription cancellations is in Section 6.

 

Section 6 – Subscriptions

Our products may be available for purchase at a discount on entering into a subscription with us. Where this is available for a product the ‘Subscribe & Save’ option is displayed during the online checkout process, along with the percentage discount and reduced price for the products. You do not need to register for an online account with us to start a subscription, but you will need to have one to manage your subscription (e.g. if you want to change the delivery frequency), you can register [here].

The subscription plan consists of: 

i. an initial delivery of the products ordered, then followed by recurring deliveries of the products at the intervals chosen by you when setting up the subscription plan (usually at intervals of four weeks or eight weeks); and

ii. an initial charge for the products, then followed by recurring charges in line with the delivery intervals as agreed to by you, for an indefinite period of time until the subscription is cancelled.

When the subscription plan you have requested is set up, you will receive an email confirming the product(s), percentage discount, the price you will be charged on a recurring basis and delivery frequency. You will also be able to see these details in your online account with us, if you have set one up.

Information about how we handle product returns under subscriptions is in our [Returns and Cancellations Policy], including returns where our products arrived damaged or are otherwise not of satisfactory quality. You have a legal right to cancel products ordered on a subscription basis for no reason within 14 days from receiving the first instalment of the products. See our [Returns and Cancellations Policy] for more information, including our returns address which is not the same as our registered office address. Please note you will need to pay the cost of delivery when returning products where you have changed your mind. We may deduct from your refund any loss in value of our products resulting from the unnecessary handling by you.

By entering into a subscription, you acknowledge that your subscription has an initial and recurring payment feature and you accept responsibility for all recurring charges prior to cancellation. Recurring charges will be taken without further authorisation from you, until you provide prior notice that you have terminated this authorisation, cancel the subscription or wish to change your payment method. To terminate your authorisation, cancel your subscription or change your payment method, log into your online account with us and follow the instructions in the ‘Subscriptions’ section of ‘My Account’.

You can add products to an existing subscription, cancel your subscription, skip a delivery, amend the delivery intervals or payment dates at any time. You will not be charged for doing so. You can cancel the subscription through your online account with us by clicking ‘Cancel’, by using the live chat feature on our website or by emailing us at info@barebiology.com, however, you must do so no less than 4 days before the next delivery is due to be sent in order to avoid receiving that delivery. We will send you an email reminder in advance of when the next delivery is due to be sent and we will email you again on the day it is sent, to let you know it is on its way.

You can re-subscribe at any time following your cancellation.

The ability to purchase our products under a ‘Subscribe & Save’ option is available at our discretion, as is the percentage reduction in the price of our products when purchased on a subscription basis.

Prices for our products are subject to change. We will give you at least 30 days’ notice in advance if we change the price or percentage reduction in price of our products purchased under an ongoing subscription between you and us. Notices of these changes will be sent to you by email, please make sure your email address registered with us in your account is accurate and up to date.

We reserve the right to refuse to allow you to set up a subscription and we may cancel a subscription with no notice and with immediate effect if fraud is suspected.

 

Section 7 - Loyalty points

Loyalty points (“Points”) may be earned when purchasing our products. Points can also be earned when you take part in our loyalty programme, such as leaving a review using the link provided in our email inviting you to leave a points earning review, or our refer a friend scheme. You can redeem Points earned when shopping with us on our Website, they cannot be used in other stores stocking our products. You will need to register for an online account with us to be able to earn Points, you can register [here]. The number of Points earned per purchase will display during check-out and your balance is available to view when you log-in to your account with us.

You cannot earn Points on any element of a purchase paid for by redeeming points.

To allow for product returns, earned points are available to be redeemed against new purchases up to 14 days from when the order the Points are earned on is dispatched. To redeem Points, follow the instructions at checkout. Points cannot be used to pay for a delivery (where delivery cost is charged for).

Points will expire 12 months after they are available to be redeemed if not used. We reserve the right to refuse to allow Points to be redeemed if fraud is suspected. Points cannot be transferred to another customer and they cannot be converted into cash.

The ability to earn Points and the different ways they are earned is available at our discretion, as is the number of Points earned for each £1 spent with us. Where you have earned Points available to spend, then we will give you at least 30 days’ notice in advance if we withdraw the ability to earn and/ or redeem Points, or if we change the number of points earned for each £1 spent.

 

Section 8 - Accuracy of billing and account information

You agree to provide current, complete and accurate purchase and account information for all purchases. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

 

Section 9 - Optional tools

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the Website is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).  We may also, in the future, offer new services and/or features through the Website (including the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

i. losses that were not caused by any breach on our part;

ii. business losses (including loss of profits, revenue, contracts, anticipated savings, goodwill or wasted expenditure) and/ or losses to non-consumers, we supply our products and this Website for consumers only;

iii. any losses that were not foreseeable or anticipated by both you and us with the contract between us was formed;

iv. losses of any kind arising from incomplete, inaccurate, out of date or false  information provided by you; or

v. losses of any kind arising from circumstances beyond our reasonable control (such as industrial action) but only where we have taken reasonable steps to prevent or mitigate the impact on the supply of our products or this Website.

This Section 15 does not affect your statutory rights as a consumer.

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The headings used in these Terms are included for convenience only and will not limit or otherwise affect these Terms.

 

Section 18 - Termination

The rights, obligations and liabilities of either party which have accrued prior to the termination date, or which are intended to have effect beyond termination, shall not be affected by the termination of these Terms. 

Subject to the preceding sentence, these Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

 

Section 19 - Entire agreement

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. 

These Terms of Service and any policies or operating rules posted by us on this Website or in respect to the Service constitutes the entire agreement and understanding between you and us and govern your use of the Service and the legally binding contract between us when you order products from us.
